There are typically two reasons for which you'd use a POA: You can't be present to take care of a financial matter, or you want someone to be able to take care of your finances in the event you become incapacitated. Power of Attorney Requirements in New York. The New York legislature has created a financial power of attorney form, which is titled Power of Attorney New York Statutory Short Form. This form can be found in the New York Consolidated Laws, General Obligations Law, Section 5-1513. There is also certain specific language required to be included, which is part of the official form. There are also special additional requirements, and an additional form, that are required if you wish to allow your agent to make certain gifts on your behalf. Be typed or printed “using letters which are legible or of clear type no less than twelve point in size, or, if in writing, a reasonable equivalent thereof."
